This agreement applies to every employer that uses TeenWurk. It governs your use of the TeenWurk platform to post jobs and connect with job seekers (the "Service"), and supplements our Terms of Service and Acceptable Use Policy. By creating an employer account or posting a job, you ("Employer," "you") agree to these terms on behalf of yourself and your organization.
TeenWurk Is a Platform, Not an Employer
TeenWurk is a neutral technology platform that helps job seekers and employers find one another. TeenWurk is not an employer, staffing agency, recruiter, or party to any employment relationship formed through the Service. We do not employ job seekers, do not control the terms or conditions of any job, and do not supervise, direct, or pay workers. Any employment relationship is solely between you and the individual you hire. You are the employer of record and are solely responsible for all obligations that come with that role.
02Labor-Law Compliance
You are solely responsible for complying with all laws that apply to your jobs and your workers, including but not limited to:
- Federal, state, and local child-labor laws, including permitted occupations, prohibited hazardous work, maximum hours, and time-of-day restrictions for minors;
- Work-permit / employment-certificate requirements where applicable;
- Wage-and-hour laws, including minimum wage, overtime, meal and rest breaks, and timely payment;
- Anti-discrimination and equal-opportunity laws;
- Workplace health and safety (e.g., OSHA) and workers' compensation requirements;
- Proper worker classification (employee vs. independent contractor) and all associated tax and withholding obligations.
You represent and warrant that every job you post and every hire you make complies with these laws. TeenWurk does not provide legal advice and does not verify your compliance.
03Job-Posting Requirements
Each job you post must:
- Be a real, currently available position — no bait listings, lead-generation, or placeholder posts;
- Accurately describe the role, duties, location, schedule, and pay;
- Be lawful and appropriate for the ages of the users who may see it, and comply with all child-labor restrictions for the location;
- Not require applicants to pay any fee, purchase anything, or provide payment information to apply;
- Not request sensitive personal information beyond what is reasonably necessary and lawful for hiring;
- Not contain discriminatory criteria prohibited by law, or misleading, fraudulent, or offensive content.
We may review, reject, or remove any posting, and may screen employer accounts, at our discretion.
04Applicant-Data Restrictions
When an applicant shares information with you through the Service, you receive it as a data recipient with strict obligations. You agree that you will:
- Use applicant information solely to evaluate and communicate about the specific job the applicant applied to;
- Not sell, rent, share, or disclose applicant information to any third party, and not use it for advertising, marketing, or profiling;
- Not build databases of, scrape, or retain applicant data beyond what is necessary and legally permitted for the hiring decision;
- Protect applicant information with appropriate security safeguards and comply with all applicable privacy laws, including those protecting minors (e.g., COPPA, CCPA/CPRA);
- Delete applicant information when it is no longer needed for a legitimate, lawful purpose, and honor deletion requests as required by law;
- Give special care to information belonging to minors and never use it to contact a minor outside a legitimate job context.
05Working With Minors
Many TeenWurk users are minors. If you hire or communicate with a minor, you must follow all applicable child-labor and safety laws, obtain any required parental consent and work permits, provide appropriate supervision, and keep all communication professional and job-related. Any exploitation of, or inappropriate conduct toward, a minor will result in immediate termination and referral to authorities. See our Minor Protection Policy.
06Indemnification
You agree to defend, indemnify, and hold harmless TeenWurk, Inc. and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your job postings, hiring decisions, or employment practices; (b) your violation of any law, including labor, wage-and-hour, child-labor, safety, or privacy laws; (c) your use or handling of applicant data; (d) any dispute between you and a job seeker; or (e) your breach of this Agreement, the Terms of Service, or the Acceptable Use Policy.
07Limitation of Liability
To the maximum extent permitted by law, TeenWurk provides the Service "as is" and disclaims all warranties. TeenWurk is not responsible for the conduct, qualifications, or reliability of any job seeker, the accuracy of any information they provide, or the outcome of any hiring decision. TeenWurk will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits or revenues, arising from your use of the Service. TeenWurk's total aggregate liability to you for any claim relating to the Service will not exceed the greater of the amounts you paid to TeenWurk in the twelve months preceding the claim or USD $100.
08Suspension & Termination
We may suspend or terminate your employer account, remove your postings, and revoke your access to applicant data at any time if you violate this Agreement or any applicable policy or law, or to protect our users — with or without notice. Obligations relating to applicant data, indemnification, and limitation of liability survive termination.
